Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Ascendant Proxies website (ascendantproxies.com), account page, proxy services, Discord community, and related services (collectively, the "Services") provided by Ascendant Proxies LLC, a United States company ("Ascendant," "we," "us," or "our").

By signing in, purchasing Services, or using the Services, you agree to these Terms, including our Acceptable Use Policy and Refund Policy, which are incorporated into them. Our Privacy Policy explains how we handle personal information. If you do not agree, you may not use the Services.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live if that is higher, to purchase or use the Services. You must provide accurate information when signing in or purchasing Services.

You may not use the Services if:

  • You are prohibited from receiving the Services under applicable law, including the export-control and sanctions rules in Section 16.
  • Your account has previously been suspended or terminated for abuse.
  • You are using the Services on behalf of another person or organization without authorization.
  • Your use would violate applicable laws, regulations, or third-party rights.

Ascendant may require additional information or verification before approving an account or providing access to certain Services.

2. Our Services

Ascendant provides digital internet proxy services: residential and mobile proxy access, sold as prepaid bandwidth billed per gigabyte.

Services may include:

  • Residential proxies (our Core and Prime pools).
  • Mobile proxies (our Mobile pool).
  • Prepaid proxy bandwidth, billed per gigabyte.
  • Rotating or sticky-session proxy configurations.
  • Proxy generation and management through your Ascendant account page.
  • Related technical and account-management services.

Specific availability, locations, targeting options, session configurations, and other features may vary by product. Ascendant does not guarantee that every proxy, IP address, geographic location, destination website, or network connection will remain continuously available.

3. Accounts

You sign in to Ascendant with your Discord account, and your Ascendant account is linked to it. You are responsible for maintaining the security of your Discord account and your proxy credentials.

  • Keep your Discord login and your proxy credentials confidential.
  • Provide accurate account information.
  • Notify Ascendant if you believe your account has been compromised.
  • Do not share your account with unauthorized individuals.
  • Do not attempt to access another customer's account.

You are responsible for activity performed through your account unless you promptly notify us of unauthorized access.

4. Proxy Credentials

Proxy credentials are provided for use by the account holder and authorized users. Your proxy username and password are separate from your Discord login, and you can reset your proxy password at any time from your account page.

You may not sell, transfer, publicly distribute, or otherwise expose Ascendant proxy credentials without authorization. If credentials are compromised, reset them and contact Ascendant support immediately. Ascendant may revoke or rotate compromised credentials.

5. Acceptable Use

You agree to comply with our Acceptable Use Policy, which is incorporated into these Terms.

You may not use the Services for illegal, fraudulent, abusive, or unauthorized activity, including fraud, phishing, credential theft or credential stuffing, malware distribution, unauthorized system access, denial-of-service attacks, harassment, spam, identity theft, payment fraud, automated checkout or cart bots, circumvention of purchase limits or anti-bot measures, unauthorized circumvention of security or access controls, intellectual-property infringement, or other unlawful activity.

6. Customer Responsibility

You are solely responsible for how you use the Services and for ensuring that your activities comply with applicable laws and the terms governing websites, services, and systems you access.

Providing proxy infrastructure does not grant you permission to access a particular website, service, account, system, or network. You are responsible for obtaining any authorization required for your intended use.

7. Customer Vetting and Verification

Ascendant may review applications, accounts, transactions, and usage for fraud prevention, security, compliance, and abuse prevention. We may request additional information regarding your identity, intended use, organization, or other information reasonably necessary to evaluate an account. Failure to provide requested information may result in delayed or denied access.

8. Suspension and Termination

Ascendant may suspend, restrict, or terminate an account if we reasonably believe that the account violates these Terms or the Acceptable Use Policy, is involved in fraud or abuse, presents a security or operational risk, involves payment disputes or fraudulent transactions, compromises our upstream providers or infrastructure, or creates legal, financial, or technical risk.

Where appropriate, Ascendant may provide notice before suspension. Immediate action may be taken where necessary to protect our infrastructure, customers, providers, or third parties.

9. Payments and Pricing

Prices are displayed on our website in U.S. dollars (USD), per gigabyte of bandwidth, at the time of purchase. All purchases are one-time payments: there are no subscriptions or recurring charges, so there is nothing to cancel.

Payments are processed by Stripe on Stripe's secure hosted checkout page. We do not receive or store your full card number. You authorize Ascendant and its payment processor to charge the amount shown at checkout for the Services you purchase. The price shown on our website is the total you pay at checkout.

You may not use fraudulent payment methods or attempt to circumvent payment requirements.

10. Delivery and Bandwidth

The Services are delivered digitally; nothing is shipped. Purchased bandwidth is added to the pool you selected on your Ascendant account as soon as your payment is confirmed, normally within minutes. You can then generate proxy endpoints and manage your proxy credentials from your account page. If purchased bandwidth has not appeared within 24 hours, contact support.

Bandwidth is measured as the data transferred through the proxy network, counting both requests and responses. Purchased bandwidth does not expire and remains on your account until used, as long as your account remains in good standing. Bandwidth remaining on an account that is terminated under Section 8 may be forfeited, subject to our Refund Policy.

11. Refunds

Refunds are governed by our Refund Policy, which is incorporated into these Terms. In summary, you may request a refund for unused bandwidth within 7 days of purchase, and bandwidth that has already been used is generally non-refundable, except as the Refund Policy provides for service problems.

12. Service Availability

We strive to provide reliable Services but do not guarantee uninterrupted availability. Services may be temporarily unavailable because of maintenance, network failures, provider outages, infrastructure failures, security incidents, internet disruptions, events outside our reasonable control, or other circumstances affecting our ability to provide the Services.

13. Third-Party Providers

Ascendant may rely on third-party infrastructure, network providers, hosting providers, payment processors, and proxy-network providers to deliver the Services. Availability and performance may therefore depend on third-party systems.

14. Intellectual Property

Ascendant's website, branding, software, interface, documentation, graphics, trademarks, and other original materials are owned by or licensed to Ascendant and may not be copied, reproduced, modified, or redistributed without authorization.

15. No Resale

You may not resell or redistribute Ascendant Services unless Ascendant has expressly authorized such activity in writing.

16. Export Controls and Sanctions

You may not purchase or use the Services if you are located in, ordinarily resident in, or organized under the laws of a country or region that we do not serve because of U.S. sanctions, export controls, or our payment processor's requirements (currently Cuba, Iran, North Korea, Syria, and the Crimea, so-called Donetsk People's Republic, and so-called Luhansk People's Republic regions of Ukraine), or if you are identified on a U.S. government restricted-party list, such as the Office of Foreign Assets Control's Specially Designated Nationals list.

You may not use the Services to evade sanctions or export controls, or to route traffic in violation of them.

17. Disclaimer

To the maximum extent permitted by applicable law, the Services are provided on an "as available" and "as is" basis. Ascendant does not guarantee that the Services will satisfy every particular use case or that a particular proxy will work with a particular website, service, platform, application, or destination.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Ascendant will not be liable for indirect, incidental, consequential, special, or punitive damages arising from your use of the Services.

To the maximum extent permitted by law, Ascendant's aggregate liability relating to the Services will not exceed the amount you paid to Ascendant for the affected Services during the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot legally be excluded.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Ascendant and its officers, employees, contractors, and service providers from claims, damages, losses, liabilities, and expenses arising from your unlawful or unauthorized use of the Services or your violation of these Terms.

20. Changes

Ascendant may modify these Terms from time to time. Updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

21. Governing Law

These Terms will be governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.
